Terms of Service

The Services are intended for parents and guardians enrolling minors ages 5–17, and for the minors themselves under parental supervision. By using the Services, you represent that you are at least 18 years old or that you have the consent of a parent or legal guardian.

You are responsible for safeguarding any credentials used to access the Services and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Submitting an enrollment form does not by itself enroll your child in a program. We will confirm placement and pricing within one business day. Tuition, refund, and cancellation policies are provided at the time of enrollment confirmation and form a separate agreement.

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any portion of the Services or interfere with their operation.
• Upload content that is abusive, harassing, hateful, or harmful to children.
• Use automated tools to scrape, harvest, or replicate the Services.
• Misrepresent your identity or affiliation.

All content, designs, logos, illustrations, curriculum materials, and software in the Services are owned by DOM Chess Academy or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended educational purpose.

If you submit content (e.g., a profile photo, message, or game annotation), you grant DOM Chess Academy a worldwide, royalty-free license to host, store, and use that content solely to operate and improve the Services. You retain ownership of your content.

The Services rely on third-party providers (e.g., Firebase, EmailJS, Expo, Apple, Google). Your use of those providers' offerings is also governed by their terms and privacy policies.

If you accessed the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and DOM Chess Academy, not Apple.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure to conform to applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation.
• Claims relating to the App, including product liability and consumer-protection claims, are our responsibility, not Apple's.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, DOM CHESS ACADEMY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify and hold harmless DOM Chess Academy and its officers, employees, and agents from any claims arising out of your use of the Services or violation of these Terms.

We may suspend or terminate your access to the Services at any time, with or without notice, for any conduct that we believe violates these Terms or harms other users. You may stop using the Services at any time.

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Middlesex County, Massachusetts.

We may update these Terms from time to time. Material changes will be announced on this page. Your continued use of the Services after changes take effect constitutes acceptance of the new Terms.
